Bookings made at this property are made under the followings terms:

HOLIDAY LETS – TERMS AND CONDITIONS

  1. This Contract of Letting is made between:

House Lettings and B & B Limited (Registration No: 12673492) (“the Company”)  of 5 Bolton Place, Bridport, Dorset, DT6 3PJ)  for the rental of Primrose Manor, Primrose Lane, Up Mudford Somerset BA21 5TD (“the Property”)

(Name of Guest/Group Leader (“the Guest”)

Proposed Dates of Letting: {{ booking.start_date }} to {{ booking.end_date }}

Cost of booking: £{{ booking.total }}

(which includes the reasonable use of the hot tub for which a fee of £100 per booking is included, provision of games equipment is also included at a fee of £50.

 

Bookings are made and accepted only on the following conditions:

 

2. The Company accepts no responsibility for personal injury to the Guest and/or his/her invitees (jointly known as “the Holidaymakers”) for loss of or damage to their property or for other matters over which the Company has no control save to the extent required by Law.

 

3. This agreement is made on the basis that the Property is to be occupied by the Holidaymakers for a holiday as mentioned in the Housing Act 1988 Schedule 1, paragraph 9 of the Rent Act 1977 and the Holidaymakers acknowledge that the tenancy granted by this agreement is not an assured tenancy and no statutory periodic tenancy will arise when it ends.

 

4. The Guest undertakes that all adult party members staying at the property have read and agree to abide by these Terms and Conditions and House Rules attached.

 

5. We do not accept bookings where the average age of adults in the group is under 25 years without prior discussion and agreement with the Company.  Bookings cannot be accepted from persons under 18 years of age. The Company must be notified of group bookings of single sex parties and the purpose of the stay.  (Hen Parties and Stag do’s may attract additional Deposits may be required).

 

6. A deposit of 20% of the cost of the holiday (“Deposit”) must accompany the booking request.  The Deposit is non-refundable unless the Company does not accept the booking as specified below.

 

7. All payments due under this agreement must be made by either BACS via the website, credit card or cheque to the Company.  In the case of payments made less than 14 days prior to the first day of rental cheques are not accepted.  Post-dated cheques are not acceptable.  Any charges raised by the Company’s bank for handling dishonoured cheques, bank transfers or any other payments will be passed on to the Guest who is liable to reimburse the Company within seven days of receipt of notification.  All payments by credit card will attract a surcharge of 1% of the transaction value.

 

8. Rentals commence at 4.30 p.m. on the first day of the rental and end at 10.00 a.m. on the day of departure, unless otherwise agreed in advance.  The period booked cannot be extended unless the Company gives prior written approval.  Any extension will incur further charges at the standard rate.  Any unauthorised occupancy  will incur costs and charges at the standard rate and any other costs, of whatever nature, by the Holidaymaker.

 

9. No bookings are valid until confirmed in writing by the Company.  

 

10. Once a booking is confirmed by the Company, the Guest is responsible for the balance of the cost of the holiday.  The cost is to be paid not later than twelve weeks before the first day of the booking.  In the event, the booking is made later than 12 weeks before it is due to commence, full payment must accompany the booking form.

 

11. The Company reserves the right to re-let any holiday where monies are more than 7 days overdue.  In such an event, the Company will retain the Deposit and any further monies paid by the Guest will be refunded.  However, if the Company is unable to re-let the holiday the Guest will remain liable for the outstanding balance of the cost of the holiday.

 

12. The Company may terminate the booking in the event of the accommodation becoming unavailable for any reason, the Company will refund all monies paid or a proportion in the case of curtailment.  The Company’s liability in those circumstances shall be limited to the cost of the holiday.  

 

13. In the event of cancellations not covered by insurance, the Company will use reasonable endeavours to re-let the accommodation, and if successful the balance of the cost will not be due as in paragraph 10 above, or if already paid, will be refunded less a £50 administration fee.  The non-refundable Deposit will be retained.

 

14. If the Property is suddenly not available to book due to the outbreak of war or pandemic and is outside the control of the Company, or the Holidaymakers, no refund on any monies will be paid.

 

15. A Guest requiring a booking to be altered once the booking has been confirmed there will be a charge of £35.00 if a revised confirmation is required.

 

16. The Holidaymakers shall keep the Property and all furniture, fixtures, fittings and effects in or on the Property in the same state of repair as at the commencement of the holiday and shall leave the Property in the same state of cleanliness and general order in which it was found.  The Holidaymaker must report and pay to the Company the cost of any damage or breakages made during their holiday occupancy.  The Guest must pay a Damage Deposit of £500 (a Security Bond) to be received by the Company 14 days prior to arrival.  The deposit will be fully refunded by the end of the week after departure provided the condition of this clause is complied with.  Please note that a fee of £100 if any issues arise from the use of the hot tub is noted and £50 for the game’s equipment provided.

 

 The Guest should provide bank account details for the return of the Security Bond 

 

17. The Holidaymakers right to occupy the Property may be forfeited without compensation if:

 

(a) More people or pets than specified on the Booking Form and/or the number the Property holds, attempt to take up occupation.

 

(b) Overnight Guests are entertained without the Company’s express permission.

 

(c) Any activity is undertaken which may cause unreasonable damage, noise or disturbance.

 

(d) The house rules attached to this agreement are breached.

 

18. All prices quoted include VAT where applicable at current rates.

 

19. Oil, electricity, heating and hot water are included in the price. We operate a fair usage policy.

 

20. In the event of there being cause for complaint concerning the Property, the matter should be taken up with the Company at once.  It is important that this is done whilst the Holidaymakers are still at the Property so that an on-the-spot investigation can be made and remedial action taken if necessary.  In no circumstances will compensation be considered for complaints raised post departure, when the Company has been denied the opportunity of investigating the complaint and endeavouring to remedy matters during the holiday.

 

21. The Company or their representative shall be allowed access to the Property at any reasonable time during any holiday occupancy.

 

22. The information in the brochure and on our website is as accurate as possible at the time of going to press.  However, facilities may be altered or withdrawn for reasons outside the Company’s control, in which case we cannot accept responsibility.

 

23. Whilst the Company has represented the property as accurately as possible, the Holidaymaker must accept that minor differences between text/photograph/illustrations in the Brochure and on the website and the actual Property may arise.   We cannot accept responsibility should the Property not conform in every detail to the Holidaymaker’s expectations.  If a facility is particularly important to you, please check with us prior to your booking.

 

24. Where the access to, layout or other physical feature of a property may be reasonably foreseen to cause individuals with restricted mobility difficulties the Company has endeavored to ensure that the information provided in respect of the property has made this clear.  Applicants are required to inform the Company in writing on submission of the Booking Form the requirements of any third party due to be residing at the property during the Applicant’s period of reservation with regard to any restricted mobility issues that may exist.

 

25. The Booking Conditions will apply to all confirmed bookings.

 

26. Any dispute will be governed by English Law.

 

 

 

 

HOUSE RULES

 

1.   Any problems must be reported within 24 hours of arrival.

 

2.   No smoking is permitted within the property.

 

3. The playing of music or making a noise which is clearly audible in a nearby    accommodation is not permitted after 11.00pm

 

4. Cooking is permitted in designated kitchen areas or on the barbecue and nowhere else on the property.

 

5. All cans, bottles, cardboard and plastic bottles must be separated and left in the designated crates which are at the bottom of the drive. 

 

 All food waste must be placed in the green bio-degradable bags in the grey food-waste caddy and when full tied up and put in the brown food-waste boxes and then left at the bottom of the drive.  

 

Remaining landfill must be put in black bags and placed in the large dustbin at the bottom of the drive.   There is one large dustbin provided solely for the use of the Guest.  If there is more rubbish than will fit into the bin with the lid closed the Guest must make arrangements for it to be removed.   The Company can undertake this at extra charge or the Guest can take the rubbish to the local refuse disposal site for which the address is provided in the Information Pack.

 

If the Company finds that this procedure hasn’t been followed and the mess that results has to be cleaned up and taken to the dump the Company may charge the  Guest £50.

 

6. The Guest agrees that the use of the Hot Tub is at the Guest’ and Holiday makers’ own risk (and that of any third party residing in the property during the period of the Applicant’s reservation) in all respects.  The Company accepts no responsibility for illness or injury to the Guest  or any member of their party arising from any breach of this clause. The Guest agrees to observe all regulations and conditions governing use of the Hot Tub detailed in ‘The Hot Tub’ section of the Information Pack presented to the Guest on arrival, and to ensure that any third party residing in the property during the period of the Guest’s reservation also abides by the same:

 

  1. all Guests must shower, preferably in the bathing clothes they are going to wear in the Hot Tub.  This is to ensure no body oils, soaps or detergents contaminate the Hot Tub.
  2. hair longer than shoulder length should be tied up.
  3. To access the Hot Tub via the dining room.
  4. to note that during use the cover must be completely removed and that it is dangerous to be in the water with the cover on or partially on
  5. as instructed in ‘The Hot Tub’ section of the Information Pack and prior to each use to test and if necessary adjust the chemical levels in the Hot Tub and to record the results, and not to use the Hot Tub if the chemical levels fall outside the safe optimum range
  6. to operate the Hot Tub strictly in accordance with the manufacturer’s instructions supplied.
  7. to make sure that the cover is always replaced after use to retain the heat.
  8. that every care should be taken when around or using the Hot Tub.

(i) Guests must not put bath bombs, bath oils or any other products into the Hot Tub.

(j) not to take glass items near or in the Hot Tub.

(k) no-one should be in the Hot Tub whilst under the influence of drugs or alcohol.

(l) it is not permitted for anyone under the age of 16 to use the Hot Tub.

(m)   not to alter or tamper with the equipment.

(n) not to behave in such a manner as to disrupt the enjoyment of the other people staying in the near vicinity or prejudice the reputation of the Company of the property.

(o) the holiday of any  Guest or third party residing or making use of the property during the period of the Guest’s reservation in breach of this clause may be terminated  immediately and without compensation or any further obligation.

(p) any damage to the Hot Tub facilities arising out of misuse, negligence and/or failure to follow the instructions herein will  be chargeable to the Guest.

(q)  if the Hot Tub has to be drained and cleaned as a result of misuse, negligence or failure to follow instructions this will incur a charge of £115.

(r)  instructions for re-heating the Hot Tub are included in the Information Pack; if the Hot Tub is allowed to cool overnight the Company reserves the right to make a supplementary charge of £15 each time this happens.

 

The Company hereby confirms the Hot Tub is safe and maintained on a regular basis. It is imperative that the correct chemical balance is maintained in the Hot Tub at all times. This will be checked by the Company or Company’s representative prior to the Guest starting their holiday. During the holiday it is the Guests’ responsibility to test and adjust chemical levels and to record the results prior to each Hot Tub session to maintain that balance.  Sticks to test Chlorine and PH levels, chemicals and instructions will be provided for this purpose.  If levels remain outside the ‘OK’ range or the Guest is in any way concerned they should contact the Company or Company’s representative immediately.  

 

7. The barbecue should be left in the condition in which it was found.  Cleaning guidance can be found in the Information Pack.   If the barbecue isn’t left in a clean condition the Guest will pay the Company £50.  With prior agreement the Company will clean the barbecue for the Guest for a charge of £40.  

 

8.   Sky lanterns are not permitted on the property.

 

9. The central heating timer settings must not be tampered with, although Guests may adjust the thermostat to raise or lower the temperature within periods of operation. 

 

10. To conserve energy Guests should switch off lights when rooms are not in use and keep windows and doors closed during centrally heated periods.

 

11.  Before retiring at night, Guests should ensure the following:

 

  1. all lights are switched off, 
  2. house doors are closed
  3. the log burner doors are closed

 

 

 

 

12. Prior to departure, it is the Guest’s responsibility to leave the property tidy, secure

      and ready for cleaning as follows:

 

  1. Removing and recycling all rubbish, as explained in Paragraph 5.
  2. Removing any excessive soiling or ‘party residue’ from affected surfaces.

(c) Removing cigarette butts and dog fouling from the property and grounds.

      (d) Running the dishwasher and returning all crockery, cutlery and other kitchen        

            items to their proper drawers and cupboards.

      (e) Cleaning the barbecue unless paying for Company cleaning, as Paragraph 7.

      (f)  Wiping food residues from the oven, hob and microwave.

      (g) Clearing food waste and crumbs from all surfaces throughout the property.

      (h) Leaving the Hot Tub clean, tidy, clear of debris and residue and with the lid on.

      (i)  Leaving all equipment in the TV Sitting Room configured as it was on arrival.

      (j)  Returning all indoor and outdoor furniture and equipment to its original position.             

      (k) Locking doors and closing windows

      (l) Returning the front door key to its original stowage and leaving all other keys 

           on the inside of the doors to which they belong
